Practice Areas
The attorneys of Dwyer, McCarthy & Associates are committed to offering our clients trusted
counsel and reliable, experienced legal practice. Our attorneys limit the focus of their practice so that
you and your case may benefit from depth of experience with cases involving injuries to our clients.
Specifically, we focus primarily on the following sorts of injury cases:
Workers Compensation: Injuries include injuries to any part of the body while working on the job.
This includes activities related to work in any field, not limited to construction and labor jobs.
It also applies to injuries suffered while travelling in the course of employment or injuries suffered
while at a work site outside of a building caused by the surroundings. Other examples include injuries
suffered in the scope of interaction with customers.
Remember, the elements of compensation for these injuries include medical bills, temporary disability payments,
and compensation for permanent disability.
Construction Site Injuries: Working on a construction site is a hazardous occupation and it exposes the worker to a wide array of dangers, including: straining, lifting, and using equipment themselves; as well as the dangers of being on and around unlevel and unsafe work areas and equipment being operated by other workers. These cases often involve workers compensation claims as well as potential claims against other contractors and general contractors for causing injury to you.
Products Liability: Such injuries can be caused by defects to equipment or tools operated by the injured person as well as injuries to a person in the surrounding area of a defective piece of equipment, and may certainly occur at a work place or on a job site. However, these cases also include injuries caused by faulty appliances, malfunctioning automobile or truck equipment, defective toys or other objects, or even serious injury suffered by food-borne defects.
Automobile Accidents: The most common cause of injuries outside of those suffered at work is injuries caused by automobile collisions (either with other automobiles or fixed objects... or both). While insurance advertisements claim that the only collisions drivers (and passengers) have to deal with are "fender-benders", our clients experience anything from severe back strains and simple head injuries, to broken bones and surgeries, to catastrophic injuries, paralysis, and death. The reality is that the human body is not designed to suffer the trauma of colliding with the inside of a multi-thousand pound object which has collided with another such object, travelling at speeds from 10 m.p.h. to 60 m.p.h. and above. Seatbelts and airbags do not offer perfect protection.
When these injuries occur, you have the right to compensation for the pain and suffering you go through as well as that which you may suffer in the future as well as for the medical costs to you.
These claims include injuries caused by Trucking Accidents and Motorcycle Accidents as well.
Premises Liability: These injuries include those which occur when you are on the land of another person: in a store; in a building; in a parking lot; in a swimming pool; and many other places. The owner and the operator of land have a duty to make the area safe for those who are standing, walking, running, climbing, or otherwise in the area. If you have slipped or tripped and fallen, or if you have suffered some other sort of injury due to unsafe walking areas, or falling objects, then you may be entitled to make a claim for your injuries against the owner of the area and the person(s) responsible for maintaining the area.
Catastrophic Injuries: When terrible incidents occur, human beings suffer serious personal injuries. You do not need to go through these events alone. Medical professionals are qualified to treat your body and your spirit. However, you also need committed legal counsel to help you navigate through these difficult times. When major injuries occur, your life is disrupted, your family is devastated, and the future is full of uncertainty and doubts. Our experienced attorneys can help put your mind at ease by answering tough questions about the legal process and how it can supplement your physical and mental recovery from catastrophic injuries.
Wrongful Death: The hardest truth about motor vehicle collisions, medical and surgical errors, construction accidents, and other traumatic and dangerous events is that those occurrences leave human lives in their wake. People die in serious accidents. The law entitles you to compensation when your loved one dies at the hands of a negligent person or as the result of a negligent act or acts. There is no way to replace the time you have lost with a person who enriched your life and other lives around them, and we understand that. But that is not the end of the story and we would be happy to discuss your options with you.
Claims Denial: When you buy insurance, they tell you that you are buying peace of mind. When you diligently pay monthly or annual premiums, you have the right to assume that when disaster strikes, your insurer will be there to help you through the process and to pay for whatever has been damaged or lost. For most, it is a rude awakening when they are told that in the midst of some tragedy that they believed to be covered by insurance, the insurance company suddenly does not want to cover the loss. Nothing requires you to take this shock lying down. The insurance company is not the final judge of their own obligations. We can help you bring them before a judge in a court of law to decide their obligations under your insurance contract...the one you fulfilled your obligations under.
